Terms of Use and Privacy Policy Agreement

  1. 1. Please read the MeetSphere Terms of Use and Privacy Policy Notice. (which may be collectively or interchangeably referred to as “ These Terms ”), the Privacy Policy and the MeetSphere App Use Agreement, in detail prior to your use of this app, service or product of MeetSphere Thailand recognizes Ltd. (hereinafter referred to as "the Company") and/or its affiliates and/or business partners. The Company realizes the importance of providing services and convenience in using services or products through the Company's application or website. as well as the privacy and protection of personal information of customers who use the service (which shall be collectively referred to as "you"), the Company has established an agreement to use MeetSphere and announcing the Privacy Policy and/or including any notices or policies that the Company may designate on a case-by-case basis, which shall be deemed part of these Terms by the Privacy Policy to inform you about the Company's practices in collecting, using and disclosing personal information to enable you to confidently use the Services through the MeetSphere Application (the "Applications") and other existing and potential services (collectively, the "Services").
  2. 2. The Company's application or website (“MeetSphere”) is owned by and under the management of the Company. It operates services that help people connect with each other, build communities, and grow businesses. These MeetSphere Terms of Use govern your use of MeetSphere, including features, apps, services, technologies and other software provided by the Company (which is called "MeetSphere’s Products", "Services" or "Products").
  3. 3. The company aims to provide you with products that are modern and meet your life style. Please be noted that your access to MeetSphere is equal to the fact that you have accepted and agreed with the company’s action as well as the MeetSphere Terms of Use and the Privacy Policy. Therefore, if you do not agree to either of the MeetSphere Terms of Use or the Privacy Policy, or both, please do not access MeetSphere.

Products and services of the company

The Company provides a variety of services subject to these Terms, including applications, websites, MeetSphere and/or promotional programs. Giving prizes/coins (such as MeetSphere coins). 1. MeetSphere users

    • You are under 18 years of age (or the minimum age required by the laws of your country to use the Company's products).
    • The Company has previously disabled your account for breach of these terms or any other policies and/or announcements, terms or policies of the Company
    • You are not authorized to obtain the Company's products, services or software under applicable law of the Company's sole discretion without the need for the Company to give any reason.

2. Terms of Use and Contraindications

The company wants everyone to use MeetSphere to express themselves and to share content that matters to themselves, but this shall not affect the safety and security of others or the ethics of the community of other MeetSphere users or encourage others to act as follows:

  1. You cannot use the Company's products or services to perform or share anything that is contrary to the Community Standards of the Company and other terms, notices, and policies that apply to your use of MeetSphere.
    • Illegal, misleading, discriminatory or deceptive
    • Infringement or contrary to the rights of others including intellectual property rights
    • Politics, religion or any institution that may cause conflict or unrest in the country
  2. You cannot upload viruses or malicious codes or take any action that may cause the Company's products or services to be disabled, overworked or impair the functioning or appearance of the Company's products or services.
  3. You cannot access or collect information from the Company's products or services using an automatic method (without the Company's prior written permission) or attempt to access information that you are not authorized to access.

3. Writing and creating content

Content on MeetSphere means and includes any materials, documents, all graphics, photographs, video, audio, logos, other multimedia and text, and other information that is created, posted, distributed, or transmitted on MeetSphere.

The MeetSphere team recommends ways to share content that benefits members to perfect the sharing experiences on MeetSphere. When you post or share content on MeetSphere, the Company will assume that you have authorized the Company to share, process and categorize those data according to the conditions of the company to other users of MeetSphere. This means that you are solely responsible for the content you share.

  1. 3.1 Friendly writing

    MeetSphere welcomes language that is easy to read, fun, friendly, and visually enhances the imagination. The company expects everyone to use polite words that convey positive meaning including the fact that the use of such words and content must not maliciously destroy anyone. In other words, you are not allowed to use vulgar, sarcastic words.

  1. 3.2 Sincerely share content

    MeetSphere always emphasizes the sincerity of sharing knowledge and experience. Therefore, the company wants to hear the facts and actual use of the service from what you do. We expect a story based on real data that is reliable with verified sources and not about what you've heard from others. We suggest against copying text from other sources without reference as well as being fair to the people or businesses mentioned in the content.

  1. 3.3 Share the right content

    MeetSphere encourages you to freely express your opinions on various aspects of the experience and story, such as sharing information related to food, beverages, menus, atmosphere, location, travel of the store or writing a description of raw materials, procedures, cooking techniques. However, the information must be accurate, truthful, without concealment and distortion, which may cause misunderstandings or any insecurity to other members. In addition, it must not be a political issue, personal matters of the shop owner or others that are not related. Therefore, if there is any damage, you will be solely responsible because the company does not have any involvement. In case of any damage causes to the company, the company reserves the right to sue to protect the rights of the company according to the law.

  1. 3.4 Public relations content

    Users can participate in various activities with MeetSphere via the application. To co-write content to help promote the store, product or organization, the owner of the store, product or organization can contact the team (through the function in the system) to create an activity topic as well.

  1. 3.5 Preserving the privacy and privacy of others who use the Service

    If you want to take pictures of the atmosphere, places or things, please respect the privacy of other people by avoiding posting pictures that clearly show their faces. If the team receives a complaint, the company reserves the right to ask for permission to delete photos without prior notice to you.

  1. 3.6 Non-Writable Content Characteristics

    MeetSphere is a place to create content from community members. However, the following content is not permitted to be displayed on MeetSphere.

    • Weapon-related content and illegal goods such as guns, hookahs, e-cigarettes, non-FDA approved drugs
    • Food and drug content that is not licensed by the FDA and has no license to advertise or content related to products with exaggerated claims
    • Able to write content to alcohol, but no logo image of the alcohol product is allowed, nor is it permitted to write solicitation under any circumstances.
    • Misleading or untrue content
    • Content that offends an individual or group of people
    • Hateful content against an individual or group of people
    • Content related to violence or crime
    • pornographic content
    • Exaggerated text content
    • Content that invites participation in network marketing or direct selling
    • Gambling-related content
    • Content related to superstition
    • Copyrighted material or any other intellectual property and you have no right to publish
    • Political, religious, or institutional content
    • If Company considers any content to be unbeneficial to other users of MeetSphere, the Company reserves the sole right to remove such content without prior notice.
    If you find any content that does not comply with MeetSphere's policies, please report the post by clicking the Report button located in the content post.

  1. 3.7 Anomaly

    MeetSphere is a medium for building a community to share content, experiences and stories. If you detect any anomalies or risks from other users or from MeetSphere itself on its applications or websites that may lead to misunderstandings or insecurity, you can report to the team for inspection. However, if the inspection team finds such an abnormality to be true, the team reserves the sole right to remove content and or community as soon as it is found, which will be considered according to our sound judgement.

  1. 3.8 Fairness to business

    All members can express their opinions freely, but good content shouldn't use harsh words, profanity, or solicits against using the service or product and should be under the law without causing unreasonable harm to the business. Since some of the writing may involve talks about raw materials, electrical equipment or tools, the writing about the product of any business may reflect positive or negative points of view. MeetSphere is not responsible for nor supports such action. If such action causes damage to the company, the company reserves the right to sue to protect the rights of the company according to the law.

4. Removing or restricting access to infringing content and community

If we take action to remove content you share and or community you own because it violates our Community Standards, these agreements may notify you and explain the options you have to submit a review request. However, your petition may not go through if you

  • have seriously or repeatedly breached these Terms or
  • have submitted a request for review again, which may result in the company or other persons being legally responsible for harm to the other user in community of the Company or
  • interfere with the integrity or operation of the Company's services, systems or products or
  • are restricted due to technical limitations or
  • are in the event that the company does not allow you to do for any legal reasons.
To help support the company's community, we encourage you to report content or actions that you believe infringe your rights (including intellectual property rights) or these terms and policies of the Company. In addition, the company can remove or restrict your access to content, community, services or data if the company considers it is reasonably necessary to do so to avoid or mitigate adverse legal or regulatory effects on MeetSphere.

5. Revisions to these Terms

The company has improved its services and developed new product features. We continue to make our services and products more efficient for you and our community. Therefore, the company may need to update these terms from time to time. To make it consistent with the services and practices of the company, the company will make any changes only when the stipulation is no longer appropriate or when the stipulation is incomplete, and only if the changes are reasonable and for your benefit only.
The company will inform you immediately via the company's products. When the revised terms come into effect, you will be bound by those terms if you continue to use our products. 6. Suspension or termination of an account and community

The company wants MeetSphere to be a place where people feel warm and secure to express themselves and share their knowledge and opinions. If the Company determines that you have clearly, seriously or repeatedly violated these terms or policies of the Company, especially including the company's community standards, the Company may temporarily suspend access to your account or permanently disable access to your account. The company may also suspend or disable your account if you repeatedly infringe the intellectual property rights of others or in the scope that the company must be taken for legal reasons.
If the company does so, the company may notify you and explain the options you have for submitting a review request. However, the petition may be unavailable if the audit may result in the company or other persons being legally responsible for harm to the user in the community of the Company, which affect or interfere with the integrity or operation of any of the Company's services, systems or products; or is in the scope of technical limitations or within the scope that the company does not allow for legal reasons.
If you delete or if the company deactivate your account and or community, these terms will be deemed terminated in accordance with the agreement between you and the Company. However, the condition of enforcement will continue without prejudice to any rights and obligations incurred prior to the termination of these Terms.

7. Limitation of Liability

The Company works hard to provide you with the best services and products and to provide you with clear guidelines for everyone who uses the Products. However, the company issues products "as is" and does not warrant that the company's services and products will always be safe, stable or error-free and does not warrant that the company's services and products will work without cause for interruption, delay or defect. In addition, the company disclaims all warranty liability whether such warranties are express or implied including implied warranties relating to merchantability, fitness for a particular purpose, property and non-infringement. The company cannot foresee when problems with its services and products will arise. Therefore, the company’s responsibility is limited to the maximum extent required by law and the Company shall not be liable for any loss of profits, income or any information caused to you including damage from consequence, special, indirect, exemplary or punitive or accidental damage caused by or in connection with these Terms or services and products in the company's MeetSphere group although the company will be informed about the possibility of such damage.

8. Controversies and Governing Laws

The Company endeavors to clearly establish these Terms in order to limit or hope to minimize disputes between you and the Company. You agree that you will use your best efforts to negotiate to reduce or settle those disputes. In the event that a negotiation or a settlement cannot be reached, you and the company agree that these terms are governed by the Constitutional Courts of the Kingdom of Thailand and the laws of the Kingdom of Thailand shall apply regardless of the conflict of laws rules of the Company.

Privacy Policy Notice

Personal information

The licenses you grant to MeetSphere

Your use of the services or products of the company means you agree that the company can show advertisements that the company believes to be relevant to you and your interests. The Company will not share information that directly identifies you (such as your name, email address or other contact information) with advertisers unless you have given the Company a specific permission. The Company provides advertisers with reports on ad performance that help advertisers understand how people interact with their content. The Company needs to obtain certain permissions from you in order to provide the Service.

  1. 1. Permissions to use content you create and share

    Some content you share or upload, such as images or videos will be protected by intellectual property laws. You own the intellectual property rights (such as copyrights or trademarks) for any such content that you create and share on MeetSphere. You can freely share your content with everyone and share anywhere you want.

    However, in providing the Company's services, The company is required to obtain legal authorization. (also known as "permission") from you to use this content. This right is solely for the purpose of providing and improving the Company's products and services as described in Section 1 above. Especially when you share, post or upload content that is protected by the Company's intellectual property rights or related to its products.     • Your content has been used by others under this license and has not been removed (in which case the license will remain in effect until that content is removed), or
    • In the event that the immediate deletion will limit the Company's ability to

      • comply with legal obligations such as evidence retention; or
      • comply with the requests of the judicial authorities administrative staff law enforcement or government agencies

  2. 2. Permission to use your name, profile picture and information about your actions on advertising and sponsored content.

    You grant the Company a license to use your name and profile picture. This includes information about the actions you take on MeetSphere next to advertisements or about advertisements, offers and other sponsored content that we display on our products without payment to you. For example, the Company may show your friends that you are interested in attending an advertising event or like a brand's page that pays for showing ads on MeetSphere to the Company.   3. 3. License to update software you use or download

    If you download or use the Company's software, this means that you grant the Company a license to download and install updates to the relevant software.

    For the purposes of and under the Company's legal base above, the Company may collect from and/or use, transmit, transfer, process and/or disclose personal data to the following persons:

You must be aware that MeetSphere may have links to other websites or apps and that those websites or apps may have privacy policies that differ from those of the Company.
